The Auction can be viewed and bid on by the public in person and through the internet, auction items will not be packaged or shipped – they must be picked up by the buyer or buyer’s representative. The current auction schedule can be found on First Capitol Auction website.

Buyer Premiums and Sales Tax will be added to the amounts of all winning bids.

Terms and Conditions
The Property is sold and conveyed to the buyer USED, "AS IS, WHERE IS". ALL SALES ARE FINAL, NO RETURNS, OR ADJUSTMENTS. The County of Santa Clara, as Seller, hereby expressly disclaims all warranties, either express or implied, including implied warranty of merchantability or fitness for a purpose, and neither assumes nor authorizes other person(s) to assume for it, any liability in connection with the sale of said Property. There are no guarantees, express or implied as to condition, usability, merchantability, or fitness for a particular purpose. Property sold is not subject to any breach of guarantee, specifications, warranties, express or implied, as to the quality or kind of any such product.
It is the sole responsibility of the buyer to assume all liability for the safety of removal, cost of removal and security of items purchased once the award of bid is made. No exceptions. Purchases must be paid within 2 days after the auction and removed from the premises in the time allocated as announced and/or posted by the Auctioneer(s), or buyer forfeits their rights to the item, and item will be relisted for sale.
